1. Acceptance of Terms#
By downloading, installing, accessing, or using Bakiye AI (“the App,” “we,” “our,” or “us”), you (“User,” “you,” or “your”) agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the App.
These Terms constitute a legally binding agreement between you and Bakiye AI. We may update these Terms from time to time, and your continued use of the App after any changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App or other reasonable means.
2. Description of Service#
Bakiye AI is a personal finance assistant application available on iOS. The App allows users to track income and expenses through voice input, receipt scanning, and manual entry. The App also provides budgeting tools, financial visualizations, AI-generated financial summaries, and a gamified companion character (“Fin-Buddy”).
Bakiye AI is designed as a personal finance tracking tool only. It does not provide financial advice, investment recommendations, tax guidance, or accounting services. The App is not a substitute for professional financial, legal, or tax advice.
3. Eligibility#
You must be at least 13 years of age (or the minimum age required in your jurisdiction) to use the App. If you are under 18 (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian to use the App.
By using the App, you represent and warrant that you meet the eligibility requirements and have the legal capacity to enter into these Terms.
4. Account and User Responsibilities#
4.1 Accurate Information#
You agree to provide accurate information when using the App. The financial records, categories, and data you enter are your responsibility. We do not verify the accuracy of user-entered financial data.
4.2 Device Security#
Because the App stores your financial data locally on your device, you are responsible for maintaining the security of your device, including using a passcode, Face ID, or Touch ID. We are not responsible for unauthorized access to your data resulting from a lost, stolen, or unsecured device.
4.3 Prohibited Uses#
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the App.
- Modify, adapt, translate, or create derivative works based on the App.
- Interfere with or disrupt the integrity or performance of the App or its related systems.
- Use the App to transmit any malware, viruses, or harmful code.
- Use automated systems, bots, or scripts to interact with the App.
- Attempt to circumvent any subscription restrictions, usage limits, or security features.
- Reproduce, distribute, sublicense, or resell the App or any part of it.
- Use the App to process financial data on behalf of third parties for commercial purposes without our prior written consent.
5. Subscriptions and Payments#
5.1 Free and Pro Tiers#
The App is available in two tiers:
- Bakiye Free: Provides limited features at no cost, including manual transaction entry and a limited number of AI-powered voice and receipt entries per month.
- Bakiye Pro: A paid subscription that unlocks all features, including unlimited voice and receipt entries, advanced analytics, full Fin-Buddy experience, widgets, and AI financial reports.
5.2 Subscription Plans#
Bakiye Pro is available as:
- Monthly Subscription: Billed monthly at the then-current price.
- Annual Subscription: Billed annually at the then-current price.
Current pricing is displayed within the App and on the subscription page. Prices may vary by region and are subject to change. Any price changes will apply to the next billing cycle following notice.
5.3 Free Trial#
We may offer a free trial period for Bakiye Pro. If a free trial is offered:
- You will not be charged during the trial period.
- At the end of the trial period, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends.
- Free trial eligibility is limited to one trial per Apple ID.
5.4 Billing and Renewal#
- All payments are processed through Apple’s App Store. Your Apple ID account will be charged upon confirmation of purchase.
- Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-current subscription price.
5.5 Cancellation#
- You may cancel your subscription at any time through your Apple ID Account Settings (Settings → Apple ID → Subscriptions).
- Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of the period you have already paid for.
- We do not provide refunds for partial billing periods.
5.6 Refunds#
Refund requests are handled by Apple in accordance with Apple’s refund policies. To request a refund, visit Apple’s Report a Problem page or contact Apple Support directly. We do not have the ability to process refunds independently of Apple.
6. AI-Powered Features#
6.1 Voice Input and Receipt Scanning#
The App uses artificial intelligence to process voice input and receipt images to extract financial data. While we strive for accuracy, AI processing may occasionally produce errors, including incorrect amounts, categories, or merchant names. You are responsible for reviewing and correcting any AI-generated entries.
6.2 AI Financial Reports#
The App may generate AI-powered financial summaries and insights based on your transaction data. These reports are informational only and do not constitute financial advice. You should not make financial decisions based solely on AI-generated reports.
6.3 No Guarantee of Accuracy#
We do not guarantee the accuracy, completeness, or reliability of any AI-generated content, including but not limited to transaction categorization, receipt data extraction, voice transcription, and financial summaries. All AI-generated content is provided on an “as-is” basis.
7. Intellectual Property#
7.1 Ownership#
The App, including its design, code, features, graphics, Fin-Buddy character, animations, user interface, and all related intellectual property, is owned by Bakiye AI and is protected by applicable copyright, trademark, and other intellectual property laws.
7.2 Limited License#
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, or create derivative works from the App.
7.3 User Content#
You retain ownership of the financial data and content you enter into the App. By using the App, you grant us a limited license to process your data solely for the purpose of providing the App’s functionality (such as AI processing of voice input and receipts). We do not claim ownership of your financial data.
7.4 Feedback#
If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation. Feedback is provided voluntarily and we are under no obligation to implement it.
8. Privacy#
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.
9. Data and Device#
9.1 Local-First Architecture#
The App is designed with a local-first architecture. Your financial data is primarily stored on your device. If you delete the App, change devices, or experience a device failure, your data may be permanently lost unless you have independently created a backup.
9.2 Data Loss#
We are not responsible for any loss of data resulting from device failure, App deletion, operating system updates, or any other cause. You are solely responsible for maintaining backups of your data.
9.3 Availability#
While we strive to keep the App available and functioning, we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
10. Disclaimers#
10.1 “As Is” Basis#
THE APP IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10.2 No Financial Advice#
THE APP IS A PERSONAL FINANCE TRACKING TOOL. IT DOES NOT PROVIDE FINANCIAL, INVESTMENT, TAX, LEGAL, OR ACCOUNTING ADVICE. ANY FINANCIAL SUMMARIES, REPORTS, OR INSIGHTS GENERATED BY THE APP ARE FOR INFORMATIONAL PURPOSES ONLY. YOU SHOULD CONSULT A QUALIFIED PROFESSIONAL BEFORE MAKING FINANCIAL DECISIONS.
10.3 Third-Party Services#
The App may rely on third-party services (such as AI processing providers and Apple’s payment infrastructure). We are not responsible for the actions, availability, or policies of third-party service providers.
11. Limitation of Liability#
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BAKIYE AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF SAVINGS, OR FINANCIAL LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
12. Indemnification#
You agree to indemnify, defend, and hold harmless Bakiye AI and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use or misuse of the App.
- Your violation of these Terms.
- Your violation of any applicable laws or regulations.
- Any content or data you enter into the App.
13. Termination#
13.1 By You#
You may stop using the App and delete it from your device at any time. If you have an active subscription, you must cancel it separately through your Apple ID Account Settings to avoid continued billing.
13.2 By Us#
We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, if we reasonably believe you have violated these Terms or if continued provision of the App is no longer commercially viable.
13.3 Effect of Termination#
Upon termination, your license to use the App is immediately revoked. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law) shall continue in effect.
14. Governing Law and Dispute Resolution#
14.1 Governing Law#
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.
14.2 Dispute Resolution#
Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to the exclusive jurisdiction of the courts of Istanbul, Turkey.
14.3 Class Action Waiver#
To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
15. General Provisions#
15.1 Entire Agreement#
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Bakiye AI regarding the use of the App and supersede all prior agreements, understandings, and communications.
15.2 Severability#
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
15.3 Waiver#
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.4 Assignment#
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
15.5 Force Majeure#
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to natural disasters, acts of government, pandemics, internet or telecommunications failures, or power outages.
16. Apple-Specific Terms#
The following additional terms apply as required by Apple:
- These Terms are between you and Bakiye AI only, not with Apple. Bakiye AI is solely responsible for the App and its content.
- Apple has no obligation to provide maintenance or support services for the App.
- In the event of the App’s failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance, or intellectual property infringement.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right to enforce these Terms against you.
